As announced in our separate notice in March 30, 2004, Canadian Custom has decided to implement 24 Hour Advanced Manifest Rule as from April 19. Similarly to US 24 Hour Advanced Manifest Rule, Carriers will be required to submit the manifest data to Canadian Custom in 24 hours prior to loading.
We would like to inform you the details for this rule as below.

Documentation Cut-off
As same as the shipment to USA, we will set the Documentation Cut-off at 09:00a.m.of two days prior to vessel arrival at origin port, while we will advertise the actual Documentation Cut-off in vessel/voyage wise separately. Any failure of submission of the Shipping Instruction or any incomplete data in the Shipping Instruction will make us impossible to submit manifest data to Canadian Custom in 24 hour prior to loading, and the loading of such containers will be rejected. We appreciate your cooperation to submit your Shipping Instruction by e-mail, by facsimile, or through Internet Shipping Instruction service in our website prior to the Documentation Cut-off without fail.

your Shipping Instruction, we will return the receipt confirmation of your
Shipping Instruction within one working hour. So, if you cannot receive our receipt confirmation, please
check us the status to the following number. Without getting our receipt confirmation, please consider
that your Shipping Instruction may not be received in our side.

The Shipping Instruction for PAX/Halifax shipments is already required to be submitted before Documentation Cut-off, since we need to send manifest data to US Custom & Border Protection as FROB shipments.

Cargo Declaration Data Charge / Cargo Declaration Data Charge Correction Fee
Similarly to the Bill of Ladings for the shipment
to USA, US$25 of the Cargo Declaration Data Charge (CDDC) will be accessed on
the Bill of Lading of
which data is submitted to Canadian Custom through NYK.
(Both Carrier¡¦s Master Bill of Lading and NVOCC¡¦s House Bill
of Lading through NYK.)
Also, US$40 of the Cargo Declaration Data
Charge Correction Fee (CDDCCF) will be accessed upon any correction request
after our Documentation Cut-off
(4) Items required to be submitted to Canadian
Custom
Full details of Bill of Lading data will be required. But we would like to highlight the several important points as below.
¡P Complete and Accurate Commodity Description
Differently from US Custom & Border
Protection, Canadian Custom will not refer to Harmonized Code (HS Code) at
all. So, it is required to submit
complete and full details about commodity description.
For your easy reference, we herewith attach the examples of correct
cargo description provided by Canadian Custom.
¡P Hazardous Shipment Information - Full details like U.N. No. / IMDG Code would be required.

Non Vessel Operating Common Carrier (NVOCC)
¡P ACI (Advance Commercial Information) NVOCC
For the customer who joined the ACI and who can send
own House Bill of Lading data directly to Canadian Custom, please notify your intention of
starting ACI submission and your Carrier Code in written to our Sales
representative before the actual implementation.
At the time
of booking, our Customer Service Team will provide the Cargo Control Number
(CCN) for the purpose of your ACI transmission. CCN basically consists as below.

Master Bill of Lading Number
Similarly
to AMS submission to US Custom, Carrier is required to submit ACI NVOCC¡¦s
manifest data in Carrier¡¦s Master Bill of Lading level. So, please submit the Shipping
Instruction for Carrier¡¦s Master Bill of Lading before our Documentation
Cut-off.
¡P Non ACI NVOCC
If you are not the participants of ACI, it
is required to submit all the related House Bills of Lading before the
Documentation Cut-off together with
the Shipping Instruction for Carrier¡¦s Master Bill of Lading. NYK will arrange manifest data
submission of House Bill of Lading to Canadian Custom on behalf of you.
¡P FROB to USA
According to the latest report by
Canadian Custom, as long as the shipments will go to USA port via
Canadian port, the manifest data in House Bill of Lading level will not be
required to be submitted to Canadian Custom in 24 hour prior to loading, while a Carrier is required to submit the manifest data to Canada
Custom in Carrier¡¦s Master Bill of Lading level. No ACI submission of House Bill of Lading data to Canadian
Custom will be required for the containers to USA on our PNX service, which
calls Vancouver prior to Seattle now.
Please visit
the FAQ section on the Canadian Customs website or the NYK website for more
information as it becomes available. NYK will be advising starting vessels from
sailing ports later, which the new requirements will be applicable for, well in
advance of the implementation date.
